We, Sander Jetten, Marcel Jetten, Petra Jetten-Schippers and Jetten Yacht Support BV, are in dispute with Mr Jack Wijnants and his company MSAR Ltd about their use of the name ‘Jetten’. Because of this dispute, we circulated Dutch and English press releases on 7 November 2019 titled ‘Waarschuwing namaak Jetten jachten & Jetten piraterij’ and ‘Jetten family warns of counterfeit yachts and Jetten brand piracy’ on, among other places, LinkedIn, Twitter and the website of Jetten Yacht Support BV. As a result of these press releases, news items were published on the website of Sea Magazine and in De Leeuwarder Courant. We also distributed the press releases via various mailings.
The preliminary relief judge of the Noord-Nederland District Court, Leeuwarden location, has ruled in a judgment rendered in preliminary relief proceedings on 15 January 2020 that these messages of ours were unlawful towards Mr Jack Wijnants and MSAR Ltd, because the messages were misleading and unnecessarily harmed their reputation. According to the preliminary relief judge, we wrongly suggested in those messages that Mr Jack Wijnants and MSAR Ltd are building counterfeit yachts and are allegedly guilty of brand piracy. Therefore, we, Sander Jetten, Marcel Jetten, Petra Jetten-Schippers and Jetten Yacht Support BV, have been ordered to rectify this.
